No idea on alcohol on any license as I've never drank so I'm not sure.

I wasn't at all thinking about traffic tickets... Some do affect us differently but most are the same. Speeding tickets accumulate points on everyone's licenses at the same rate.

You can't do deferred adjudication or defensive driving to get them dismissed, though.

True, I was fast with my response, a few things are different but most are the same.

But their company can't be sued...

They can if they're in a company vehicle and hit someone. If this guy shot those people with a dept issued firearm, it's the exact same thing.

Its new york you cant walk 3 blocks without seeing a lawyer. They will settle just like every department does. They dont want an open courtroom.

That I agree with but I don't know any officers that carry their duty weapon off duty. Not to say it doesn't happen but its generally too big to conceal.

Can he detain you or arrest you with him off duty?

If the guy was off duty I don't see how the city is liable, but I sure a lawyer will try to figure out a way. I will say the dumb shit needs to be behind bars for sure.

Most officers in NYC do not own a personal firearm. The weather is also cooler and they wear heavier clothing making carrying a full size hand gun pretty easy. There is also a very limited number of department permitted firearms to pick from if you want to go through the effort to get a personal one to carry.

My buddy is with the NYPD and works as an investigator for the Manhattan DAs office; that is the only reason I am familiar with how they do things up there.

If I can carry 2 J frames and a Hi-Power while wearing cargo pants and a polo shirt then they can hide a full size Glock while wearing a jacket.

If the officer maintains his authority while off duty (ie, if you hit him, is it simple assault or assaulting an officer?) then sue the fuck out of the city and put them into bankruptcy.
