According to Texas Penal Code CH 46 (Weapons) a firearm is described as:

(3) "Firearm" means any device designed, made, or adapted to expel a projectile through a barrel by using the energy generated by an explosion or burning substance or any device readily convertible to that use.

Sec. 42.12. DISCHARGE OF FIREARM IN CERTAIN MUNICIPALITIES. (a) A person commits an offense if the person recklessly discharges a firearm inside the corporate limits of a municipality having a population of 100,000 or more.

(b) An offense under this section is a Class A misdemeanor.

(c) If conduct constituting an offense under this section also constitutes an offense under another section of this code, the person may be prosecuted under either section.

(d) Subsection (a) does not affect the authority of a municipality to enact an ordinance which prohibits the discharge of a firearm.

US Census Bureau shows in 2011 the population of Frisco was 121,387, so the above statute applies.

Now the hang up would be the word "recklessly". Are you reckless if you are engaging a varmint that is attacking a domestic animal? If you do, you are subjecting yourself to the interpretation of that one word.

The best bet would be contact Frisco animal control and ask them what the best course of action is.

You need to check with the city and see if there are any specific ordinances relating to discharging firearms in the city limits.

If you decide to take matters into your own hands, do it alone and for Pete's sake don't post it!
