Why would they get raided? From what I understand, no rake = legal. Tips= legal. Byob. Cops have better things to do than raid small home poker games.

Tips != legal.

The defense against prosecution requires 3 elements:

1. The gambling occurs in a private place
2. No person receives economic benefit other than personal winnings
3. The chances of winning are equal for all participants

So if you are leaving money in a tip jar, paying the home owner $2 a beer, paying a rake or a seat fee... the game is technically illegal in Texas.

But you are right the numbers y'all are talking are small fish and probably are not worth going after... unless you are advertising them on a public message board.
