  • Unknown Insurance Question

    Cliff notes:

    -Wife hit dude after he came across three lanes without looking. She was in a left turn lane with no-where to go. She hit his driver rear quarter panel with her front passenger side..
    -Dude wouldn't cough up info.
    -We Called Po-Po.
    -Dude had no DL and was listed as "exluded" on the car's insurance policy.
    -Insruance is "Lopez Auto Insurance" Based out of Irving.
    -Dude got lippy with Po-Po and ended up in jail.
    -We have Police Report Number that states all of the above


    So,
    I just want her car fixed and back to normal. It's in excellent shape, fairly new, and no other damage.

    From our side of the coin since it's hard to prove fault either way... Do we?

    -Call our Ins (State Farm) and let them duke it out with Lopez?
    -Try to get Lopez Ins to do anything?
    -Cry myself to sleep?

    It boils down to-
    Are you going to fix it yourself?
    Do you need insurance to fix it?

    If you are going to fix it yourself - then just fix it and don't call anyone.
    If you need insurance to fix it - call your insurance pay the deductible and let them sue the person that hit you.

      If he's an excluded driver on the policy, you'll be wasting your time trying to get them to cover the accident. How bad is the damage? If there's enough damage to risk raising your rates, file with your insurance. If not, pay out of pocket.

        Dude, it can take a while for the insurance companies to resolve it. Best is to have your insurance pay to repair yalls vehicle and let them duke it out in court. I had one customer who went through the same thing and the insurance companies were going at it for at least 6-months trying to determine who was at fault..

          Probably just going to pay out of pocket if it's less than a few thousand and move on. I'm hopping to get an estimate in the next few days.

          Just sucks that we pay for "good" insurance and keep our cars nice and some asshole in a beat down jetta ruins that for us.

            What kind of damage does the vehicle have? Were do you reside at?

            I had one customer who was 4 payments from paying of his car, and BAMMM!! Totaled by some Mexican with no insurance.

              You should have uninsured motorist coverage. If he is in jail for no insurance he will have to pay fines into the texas uninsured motorist fund

                I would turn it in on my UMC if I were in that situation. Insurance companies retain lawyers for this purpose who can take the issue back where it belongs - the responsible party.

                    I'd do an uninsured claim and let State Farm touch him gently in his intestines.

                    Also, sounds there was a damn good reason he was listed as "excluded".

                      As already mentioned, UMC will cover it, you pay it for a reason.

                      Same basic shit happened to me a few years ago. 15 year old took her Grnadma's car while she was out of town, hit me, got out and ran away. I filed it on my UMC policy since G-ma said she did not have permission to driver her car.

                        Talked to the officer today and sounds like the guy went slightly nuts after we left.

                          My wife was hit by an uninsured driver. We filed it through our uninsured driver insurance and paid the deductible. We received the deductible back a couple years later. I guess the insurance company was able to sue him.

                            Sucks this happened to your wife. Hoping you carry uninsured motorist, you can file a claim under your uninsured motorist coverage and cough up the $250 deductible. If you for some reason don't carry uninsured, as long as you have collision coverage you should be alright as well, minus your deductible of course.

                            Your company at that point should take care of you and get your on your way and start the subrogation process. As TexasDevilDog mentioned, if they can recuperate your deductible you may end up getting that back at some point.

                            Lopez Insurance more than likely is just an agency that works through several carriers. The insurance company or MGA would more than likely be listed on the policy as well but usually have their own claim service company or it may be handled by a third party or via the MGA. The difficulties you face are going to be great given that you have mentioned that this person was excluded from the policy. The other part may come from the claim experience you will have trying to get the claim handled.

                            Your best bet is to contact your agent and explain the situation and have your insurance company handle everything.

                              It boils down to the fact that you paid and played by the rules. He did not. You got screwed without a kiss or even a "Reach Around". You most likely are not the first and I bet not the last person that he will screw. Bet if he votes, he is a Democrat.
