NEVER FILE A CLAIM ON YOUR INSURANCE IF YOU ARE NOT AT FAULT!!! Why would anyone want a claim on their policy? So their rates can go up? So the company looks at them negatively? So they can have an excuse to drop you from their policy? You only file with your company if they are refusing to pay and claiming it is your fault. Id get a lawyer to send them a letter claiming innocence before filing on my insurance.

I didn't tell him to FILE on his insurance, I told him to get his insurance involved in it and let them handle it. That is what you pay them for.

Its very doubtful they will help. Same situation happened to my fiance's little brother. He rear ended some clown pulling out of a parking lot and his insurance is blaming her brother. He called Allstate and they said to file a claim and they will go after the insurance company. They were not willing to help without filing a claim.
