Yeah, I see nothing that would indicate they fired her because of being pregnant. Just cause you did not misconduct and are capable of working, does not mean you cannot be fired.

If they 'fired' her, that is typically misconduct. A lay-off/reduction in force, etc. is eligible for unemployment benefits. Her former employer apparently is not disputing your wife's eligibility for unemployment benefits, hence a lay-off/reduction in force type issue. Texas is an employment-at-will state. You can let an employee go for any reason with or without case as long as you aren't discriminating under Title VII.
I terminated a pregnant lady a while back and it had nothing to do with her being pregnant, but of course she claimed that was the case. I told her I had her employee file with several documented cases of misconduct if she wanted to hire a labor attorney to come after our company. I never heard from her again.Ford
