  • Law question...

    So a couple years me and my girl broke our lease on our Apt to get a house.. The lease showed we had to pay remaining lease for the APT.. Which we made partial payment but did not pay in full..

    The question comes in.. They sent this to a collection agency to collect the Debt and I received a Letter(dated mar 10,2011) saying that if they did not receive the full payment by Mar 25, 2011 they would send it to my Experian Credit.. Well here it is Mar 12,2011 And I went to get a car and this company has already sent it against my credit back in February.. Do I have any case against this not giving us the time to respond? and better yet sending against my credit almost a month before I even got the letter.


    We have a lawyer.. just wondering if it is worth the money/hassle to fight this.

      If this all happened a couple of years ago then it has already been on your credit. Scavenger Debt collectors will tell you anything you want to hear, or make any ridiculous threat they can to try and collect. In reality, it is rare that they can do anything other than try to annoy you into paying.

        ..and no you don't have a case. Dispute it with Experian. Most of the times the creditor won't respond within 30 days and it will drop off your report. Even if it should be on there, which in this case it should. When you don't pay something or are late, it goes against your credit. That is how credit works.

          I understand how credit works..but it was sent to my credit on february 25 2011..which is not long ago..2 weeks before I got the letter.. But probably doesn't matter was just curious..

              It doesn't matter. After either 60 or 90 days of delinquency (I forget which), unpaid debts can be reported to the credit bureaus. They do not ever have to notify you that they are doing it.

                    When you break a lease you are breaking your contract, so no, you do not get the leniency of making payments.. Unless it was agreed upon that you can make payments then you are screwed.

                    As Talisman stated, dispute it from your credit, cross your fingers and make better decisions in the future.

                    When you applied for the loan did they tell you your credit score?

                      Yeah.. Went from 715 mid february to 658 after the credit thing was put on there on one off them
