  • Wife had an accident, what’s my best option?

    So my wife had a car accident yesterday and other driver is at fault with multiple eye witnesses and his statement on the police report confirms it too. My wife has a shattered finger that they temporarily cast and now have to see an orthopedic specialist. My Q is about insurance. I’ve only had to file when I wrecked by myself or had hail damage, but never with another vehicle involved.
    So do I
    1. File on my insurance and then let my insurance go after the other insurance.
    2. Get ahold of their insurance and go straight through them.
    3. Get a traffic accident lawyer so we don’t get screwed on medical bills and get potentially a better reimbursement for work/time/pain.

    1. Only as a last resort.
    2. Do this unless things break down and you have no other recourse to get things taken of than go to option 1.
    3. Having been on the other side of things and been the at fault on an accident, I hate these accident lawyers with a passion. Not that I've been in a lot of accidents but in my first experience, I accidentally rear ended someone only to find out it was the neighbor of a friend of mine and they took full advantage of it. I on the other hand have been hit and never had to resort to hiring an accident lawyer.

    Anyway, just my two cents.

        File on the others persons insurance first. If they deny the claim or give you a big hassle, file on yours, pay your deductible and your insurance may or may not get your deductibles back. Lawyers general just slow everything down and make the money to my knowledge.

          Since there are witnesses the other driver's insurance should accept liability in fairly short order. Just in case you resort to using your own however, do you carry full coverage and have personal injury protection (PIP) on your policy? I don't carry PIP myself, and the only time I made a claim against the at-fault driver's policy (State Farm) there was only property damage and they balked at accepting liability until a witness made a statement to them. Our own insurance (GEICO) did not include collision since the car had been paid off, and they basically said they would do nothing.

              We have full coverage and pip. Others insurance is Allstate. We called there insurance and they already had a claim started. We’ll see how this goes...

                  You're probably good. When these fucks that have fred loya or some other ghetto ass insurance is when you need to worry.

                      Not sure if you got process started already.

                      Option 2 is the way to go normally. Unless the other party has an insurance carrier that you feel may not handle the claim in a timely manner, or if you have the claim open and the other insurance carrier is giving you a hard time. Then you would open a claim under your policy, let your insurance cover your claim and they will subrogate with the other carrier and try to recuperate your deductible and any monies paid out. Keep in mind to make sure you policy either carrier PIP (personal injury protection), at the very least medical coverage. If not, your policy may only cover your vehicle damages, leaving you with out of pocket medical expenses.

                        So far their insurance is on top of everything with the car side, we’ll see how it pans out with medical.
