If the opposite had happened, and Botham Jean had shot and killed the intruder in the dark within his own apartment, he would have been immediately arrested and likely be charged with capital murder. Useless speculation though, since he isn't here to tell his version of events.

That's my biggest complaint about the war on some drugs. If they had found one pill outside of a prescription bottle or a single joint they would have swept the shooting under the rug and not charged the officer.

A man shot and killed an officer serving a no-knock warrant down by Austin less than 2 years ago. He was no billed on the capital murder but was still arrested for the drug possession charge.

Time flys, this happened in 2013 and the man has been out of jail for a few years now.
