That is a good angle. They won't appreciate that at all.

good call. I need to find out where that dirt came from. I'll start calling around to some pool companies and see if they use them

There may be a reason why they are dumping the dirt. If it is contaminated then only certain places can dispose of it and every load costs the contractor money. This is all typical process for cleaning up a contaminated site. If you want someone to test the dirt I have a group down in Houston that does all of my work exclusively. They have a local office too. I am sure they can get it done for a few hundred dollars and write you a report on the findings. Let me know if you want their info, they are well known and trusted by institutional real estate investors.

If the dirt is contaminated you are going to need to sue the contractor and whoever is having the pool built.

Maybe tell them to get a bulldozer and even it out or maybe sell the dirt if its not contaminated is my thought.

If they really are working for a pool company, I doubt it is contaminated. Those guys are cheap ass SOB's. They try to dump shit on our lots all of the time. Not this contractor, but excavators for pool companies. Every time there is a pool going in, we either catch a truck trying to dump, or they come to our office to see if we need any fill to build up our house pads.

I doubt there is any contamination, they just don't want to drive any farther than they have to.

This is what 2 pool companies told me. Im going to the city today to pull all the pool permits in the last month or two and going to drive around to find the site. The two dirt types are totally different. The largest bunch is a sandy light brown mix. This crap they dumped yesterday is rocky clay.

Nothing. lol. We typically grade the dirt down or we catch them in time to run them off.

I figured... Well, Im also contacting TCEQ which takes complaints of environmental quality. The company had a complaint against them in 2004 for illegal dumping.

That sandy fill might be worth holding on to. The clay can definitely go.

Also, put a sign up that says no dumping, I see similar ones all the time on empty lots.
