    Late Sunday night, Hernandez’s family stopped at the Denny’s restaurant on Crosby Freeway near Sheldon. After celebrating his beloved Chivas soccer team’s victory, Hernandez was drunk, his wife said. She insisted he have coffee.
    Instead, surveillance cameras showed Hernandez walking outside with his wife trying to stop him. She said her husband urinated near their vehicle.
    Another man, who was identified Friday morning by the sheriff as 48-year-old (first name not given) Thompson and whose wife is a sheriff deputy, was outside with his kids and confronted Hernandez about his behavior. Video showed the two men scuffling.
    People ran outside while Hernandez’s wife and 3-year-old daughter watched and screamed.
    “She was crying and telling (the man beating Hernandez) stop and he didn’t even stop,” Hernandez’s wife said. “I told him please stop. Don’t do that to him. He’s drunk. He wasn’t in any position to fight. But, he didn’t have any compassion. He was really angry.”
    Hernandez’s wife claims deputies took her cell phone then led her away for interviews. Nearly three days later, her husband was still in the intensive care unit at LBJ Hospital before he was eventually taken off life support.
    Meanwhile, the report given to the family called the man who beat Hernandez the victim.
    In a statement released earlier this week, a spokesman for the sheriff’s office told KHOU 11 News the matter is under investigation.
    The Hernandez family, though, wonders if they will get justice given the other man’s connections.
    “They feel that they can get it covered up because they are cops,” Hernandez’s wife said.
    An eyewitness who spoke with KHOU-11 on Thursday on the condition of anonymity told us Hernandez was drunk and defenseless as he was beaten by the off-duty deputy’s husband.
    The eyewitness contradicts a statement from the Harris County Sheriff’s Office which states the off-duty deputy assisted in restraining Hernandez and then administered CPR when she noticed he was not breathing.
    “Even after I told him ‘stop, stop’ and other people were screaming he wouldn’t do it,” the eyewitness said. “Even after his wife came he didn’t do it. “His wife didn’t do anything, because I went in to call the police she was already there on the side and I didn’t see her do anything, I didn’t hear tell him stop. I didn’t hear her tell him anything. She just was watching.”
    The eyewitness tells KHOU 11 Hernandez was held in a chokehold by the deputy’s husband for more than 10 minutes and was not breathing.

      Well....I guess his celebrating did not go well. Drunk....pissing in a public parking lot with kids present.....fighting with his wife and kids present.....what could go wrong?

        Doesn't excuse the fact some guy choked him out and killed him if in fact that's how it went down.

          You know that's what's messed up. If there are cameras, the business will generally only show footage to the police. Someone hit my car at Sams club, they won't show you. Same thing with a friend getting a cell stolen at a restaurant. The restaurant had footage and told my friend they would only show police. If it is mistrust of law enforcement, that's going to suck. Maybe a judge will subpoena the footage, but of course there may not be any after all, once that happens.

              Exactly, you know​ how how many times I've come across guys pissing in parking lots, I've even had my wife and kids at times, hell women too. Never once have I felt the need to kill them or confront. This guy should have called the cops, but since his wife is a LEO, I guess that makes him one too.

                We are hearing one side of the story and again, video footage would clear some of this up. That being said, I'm sure a drunken argument ensued followed by the fight. I wouldn't think he saw Hernandez pissing in public and immediately went up to him and started beating his ass. But only the video would clear that up.

                Lot of things went wrong for this guy before he got into the fight that would eventually end his life. Getting drunk. Going to a public place drunk. Urinating in public. And probably arguing with his wife as well. I'm not saying he deserved to die, but so many times it's the other way around. A drunk person (people) getting into arguments in public, doing stupid things, getting into fights, and someone dying.

                    There seems to be a gap in the story. Did the drunk start swinging at the dude? I doubt anyone would just walk up to someone drunk, pissing in a parking lot of a dennys and just toss them in a headlock and kill them.

                          I'm sure Karma is playing some role here.....I mean after-all, it sounds as though Hernandez was an outstanding role model for society and a great family man....probably never once beat the shit out of his wife or kids.

                              Man, seriously. A man should now how much alcohol he is capable of handling and have the mindset to stay below that limit. If someone does want to get totally wasted, do it at home. He'd still be alive to get drunk another day.

                              I do it and I'm not a heavy drinker. I know to stop after about 3 long island teas or a couple of beers and a LIT. I can tell the wife that I can't drive. It's called responsibility and that guy didn't have it.

                              Now, I am making one assumption...that Hernandez did something to provoked the other guy or escalate the situation. Since alcohol was involved, you know it's highly probable.
