  • Tenant question

    My girlfriend's mom passed away Sunday. She was on month to month lease and it ends the 30th. The owner says that everything has to be moved out by July 1, giving us about a week and a half to get everything. I have 2 questions: is this right, just 10 days to get out (if it had been the day before the lease was up, she'd have to have it empty in a day)?

    Second, what would happen if we got everything we want and left the rest?

    2. WTF they gonna do about it. I would take what I wanted and leave the rest mostly just because its seems like they are coming across as assholes at a time like this.

      Thank you sir. We're Just worried about them charging BS cleaning and storage fees that exceed the deposit, and go after her mom's executor (her brother) to collect

          Sorry to hear Tony.

          Even in a m2m lease there is a 30 day move out clause (It could be 45 days or more). Since she died a few days ago, I doubt that she was supposed to move out by the first of July, If she did then you really have no wiggle room and must move out. If she did not then you give them the notice of however long it was, you will have to pay the next months rent, but you will have time to move out and clean up to get your deposit back.

          It sounds like these landlords are assholes so you're probably not going to get the deposit back unless the house/apartment is in pristine condition. So like Paul said, take what you want and let them earn that deposit money...

            No, it's just a matter of time. Work on top of everything she has to take care of related to the death, on top of everything else we have going on. It'd be so much easier ti we had s little more time or if we didn't have to get everything out

              Dealt with this when my mom died last year. It sucks, but I had 1 week to move her stuff. Nothing I could do.

                IIRC... They can legally charge storage fees and/or clean out fees against the estate. Cross Ts and dot Is in this case.

                  I'd ask for a copy of the lease paperwork, or preferably her mom had it on file somewhere, to see what the move out clause is. According to a quick Google-fu, either you get everything out by EOM, or pay another month's rent to get more time.

                  My sincerest condolences for your loss Tony, but I don't see this as any kind of dick move. Though it may look callous to you, for the landlord it's a business, and he/she very well may have a mortgage on the property, and needs the rent to keep coming in. If you need more time, then her estate will have to pay for it, time is money after all.

                  The dick move will be when you spot clean the property and they still keep the deposit, which in my experience is very likely to happen.

                  Ideally you get everything out by EOM, and keep the deposit, but if that's just not possible, either you leave what you have to and forfeit the deposit, or pay another month's rent.

                        Assuming they use a TREC form the first page shows what happens when you go month to month. Usually landlord or tenant have to give a WRITTEN 30 days notice. In this case It sounds like getting it empty sooner would benefit you all as to not have to pay next months rent. Depending on the deposit and how much trash they can come after you but its costly and time consuming so unless you leave it trashed they "probably" wouldn't but that's just speaking for myself. We are pretty easy on our tenants though as long as they are trying to do the right thing. Its also a strong market right now so they're better off getting it from you this month instead of next to rent it out. Thats just my guess.

                          Debt does not transfer in a death situation...So the executor is safe..

                          BUT if she has any kind of money in an estate then they will take the money owed from there

                            If you don't care about getting the deposit back just leave what you don't want. There will definitely be a fee for leaving things.
