So I hired an attorney today. Is going to contact my insurance and seek their help and fight the other guys insurance. My lawyer called me back right after I left his office. And told me that he'll have a van come pick me up from my house to start physical therapy this Monday. So I figure I probably need about four months of therapy to relieve some of my pain and suffering.

Since you have contacted an attorney, they attorney will be doing all of the legwork with your insurance. Your provider may not release much information directly to you at this point since the attorney is involved btw.

As others mention, assuming you do have uninsured/underinsured motorist coverage you should be able to claim through that coverage to get started should the other persons insurance not accept liability due to a couple of reasons for example if the person isn't listed on the policy, excluded or any of those factors. Including if their insurance caps out at certain limits and your insurance needs to pick up the underinsured amount.

In regards to your personal injury coverage, you should be protected if you indeed have it without having to pay any type of deductible. Your carrier will go through subrogation at that time which may take some time. The same thing could result in your policy having to cover the collision meanwhile, as well as the rental car.

What I normally see is the attorneys go after your insurance for everything your have on your policy first, I assume because they know your carrier will likely cover everything from the get go and they will start getting paid as well. Then at some point when your insurance goes through subrogation, their own attorneys will take care of everything at that point with the other carrier. You will be responsible for any deductibles in the meantime, and you will have to wait for reimbursement, when and if your insurance carrier receives that in their settlement of course.

Also, if you are in need of a rental car, I would check your policy to see what value you have for a vehicle and contact enterprise and give them your information for the claim at least from your policy once your attorney gets that claim number to you. You can get the rental vehicle and make sure to put a credit card on file, not a debit card so you won't get stuck having to pay a huge deposit. With a cc you won't ever get charged, it will just be a hold on the card meanwhile either your carrier takes liability of the rental or the other insurance provider.
