      It's both. Has to be in writing up front:

      Payouts of accrued leave are required under the Texas Payday Law only if such a payment is promised by the employer in a written policy or agreement.

        Submit as late as you can. Take vacation and submit the day you return.

        Depending on you job be prepared to be shown out the door.

        I left Halliburton last month. I gave 2 weeks notice and was gone in an hour. Which is what I needed and expected anyways. 6 days later I was on the other side of the world working already.

          Exactly. I would think anything promised in writing would have to be honored. But, barring that, they don't have to pay accrued PTO.

            My former employer would pay accrued PTO as long as you worked 10 business days afterward. Yeah legally they don't have to since it's a benefit but that was our corporate policy. I ended up losing two hours of PTO since I decided to bail at the end of a pay period (two days shy).

            Also expect a counter offer if you are fairly valuable. Then expect to be canned as soon as they have a replacement for you.

              @Bold. This. Most accepted counter offers are short term for the taker. It just buys time for the employer to find a "loyal" employee. I've heard of counter-offers working for a few people, but more often the accept-or moves to special projects then is let go when that project is complete.

                I gave my last company two months notice. I had projects that needed to be completed, and it gave me time to square up with some of my longtime clients.

                  No, they can let you go on the spot when you give a notice. I gave a months notice to a company, and they opt'd to let me go after a week maybe 10 days. You also can not file for unemployment if they let you go before your notice duration is up.

                  The notice is a simple courtesy to the business, they dont have to honor it.

                    I quit for $50k more, they countered with $60k more, I countered with $60k and a 20% bonus instead of a 10%. I still work for that company 2+ years later. I dont think they will replace me anytime soon. I have to goto swtizerland in June for another meeting. Just depends on how valuable you really are.

                        We will pay PTO if they leave on good terms with notice and are a good employee. Otherwise, if you don't give notice and/or suck, we are not legally obligated to pay out PTO.

                        If your boss is an a** and you don't have any loyalty to the company and they don't have any loyalty to you, you technically don't have to provide notice.

                              There are some industries that it's important to keep customer base, security, etc. and they dont want you to stay after you tell them your intentions. I could fuck up shit from my desk that would take months to clean up.

                                Is it law that you have to give it at all? I know it was in California. Probably why they started letting everyone have infinite PTO instead of giving people PTO hours.

                                Not really. I've busted my ass the last 10 years, my post count went from like 60 a day to .01. I'm only gangster in WSG when I'm carrying the flag and have all my protective cooldowns.
