I guess it's just how I've learned to deal with it but I always put my keys on the dash and act like it's a casual conversation. I assume by running your plates thy can also pull up your record if you're the registered owner, so if you had a possession charge at some point they are probably looking to find out if you're carrying again

Not really. I could blind search you off of your plate but I just can't get criminal history off of my MDT. Generally to find some ones DL you need gender/race and DOB also unless their name is really unique. John Smith and no dice there will be 300 of them. My dispatch has to run you for a complete CCH. Then I have to sign a sheet and send it back somewhere in the day for that kind of info. Now your DL info will show some drug courses that you were required to take care of at some point to get your license reinstated but that falls off in a few years . Still generally need more reason to pull CCH, like area you are in, time of day, carotid artery bulging off your neck, sweating, reaching around under the seat, missing teeth etc.... Also if you are reaching around under your seat and making furtive movements we can search that area of your car only.
      Whos your Daddy?

I've had something similar happen to me but I told the officer to get a warrant. Well, I guess that pissed him off because he brought a dog out who "alerted" on my car...a car I had for years that certainly had nothing to alert on. The pig commenced to trashing my car. He tore off the glove box, tore the molding in the trunk getting the spare out and dumped my suitcases out on the side of the interstate. When he didn't find anything he gave me a card with a number and said, "You should have given consent to begin with if you had nothing to hide. Call that number if you want to file a complaint...but, you better hope I don't pull you over again."
This was when I was in med school...and I've never done any form of illegal drugs in my life. Add in the shit with my brother's dog and it's no wonder why I'm FTP.
Also why you record every interaction.

Fuck Carrollton PD, in fact fuck that city altogether. I try to avoid it, however I detoured recently.

Josey Lane just south of Belt Line is a 6 lane major thoroughfare where I received a speeding ticket recently for 46 in a 35. 35? 35? OK, so every other fucking place around here it's 40 but through this armpit it's 35. Useless fucking town. I stay outta that shit hole.

So after getting out of your vehicle and you seeing that both your headlights were working, you still consented to the search? Sorry if I missed this somewhere but if both headlights were working, doesn't that void his PC and reason to search?

Ya i had some POS fucking cop in Burleson pull me over in my coupe when i was young (17) and was a complete dick and searched my car with a few other cops. They ripped the seats out of the car and trashed some other stuff and of course didn't find anything. I've never wanted to hurt a cop more in my life then that day, when they left they just left all the parts out on the ground and said clean it up. He accually left the scene and got into a accident few minutes later so i was happy about that ....some are cool but fuck the majority of them.

Hell to the no on the consent to search. A#1 reason I finally installed my dash cam in my car recently.

Yeah I was puzzled myself and really didnt feel like hurting them until they broke my hatch. Which is fixed now btw....

Taking a stroll today down to the CPD which is down the street from my job to file a complaint. I made a few calls yesterday and nothing.

The best thing I see now is when refusal to search and stopped on a class c, individual arrested on that class C and then the car is "inventoried" so you can't come a claim anything missing from it on the way to impound.

That is a no no. Like I said earlier, either make the decision to arrest prior to search, or let them role.

Also on the whole warrant thing or any coercion .

Bumper v. North Carolina (1968) 391 US 543. A claim by officers that "We have a search warrant," or "We'll be back with a search warrant," makes a consequent "consent" involuntary, and invalid. (It would be permissible to say, "If you don't consent, we'll try to get a warrant," since this implies that a refusal of consent will be honored, and that returning with a warrant is not a foregone conclusion.)

Even if the speed limit would have been 40, you were still speeding...

This is kinda funny to me. with the armchair quarterbacking after the fact.

When I was 16, got my licence, and started getting pulled over so often I was on a first name basis with most of the officers in Duncanville. Being a Junior, my plates and address were the same as my dad's, and since he was known for drugs by the PD, I was just fucked. Get pulled over on the way to school because my turn signal didnt flash enough times, etc. Stupid bullshit. They searched my truck all the time, no consent, didnt even ask. I was put in cuffs and stuffed in the back of a squad car on a weekly basis. They were crooked as hell back then, so going up the chain wasnt even an option.

I was damn sure guilty until proven innocent, and it took a while before the officers figured out I wasnt my dad, and I wasnt going to have anything on me.

Might be a no no for you, but it's happening with regularity.

Don't be a fucking idiot, never consent to a search. What was his probable cause? If he used a headlight out and it wasn't, his PC evaporates. Tell him to feel free to lie to a magistrate to get that warrant, and you'll shove it up his ass in court. I could give you the 4th & 14th analysis, but I think it would bore you
