The company said that a bakery team member wrote only “Love Wins” at the top of the cake as Brown requested. This was visible to Brown through the clear portion of the packaging, Whole Foods said.

“That’s exactly how the cake was packaged and sold at the store,” the company said. “Whole Foods Market has a strict policy that prohibits team members from accepting or designing bakery orders that include language or images that are offensive.”

The retailer went on to say Brown admitted that he was in sole possession and control of the cake until he posted his video, which showed the UPC label on the bottom and side of the box.

“After reviewing their security footage of Mr. Brown, it’s clear that the UPC label was in fact on top of the cake box, not on the side of the package,” Whole Foods said. “This is evident as the cashier scans the UPC code on top of the box, which you can view here.”

The company said it continues to stand behind its team members.

“We stand behind our bakery team member, who is part of the LGBTQ community, and we appreciate the team members and shoppers who recognize that this claim is completely false and directly contradicts Whole Foods Market’s inclusive culture, which celebrates diversity,” the company said.

About 20 years ago I was the overnight cashier at Albertsons in mesquite, this lady comes in around 3am to pick up her sons birthday cake. I walk back to the bakery with her I found the cake. It was a Teletubbies cake out of the blue she asked what do I think of a Teletubbies cake for a 11 year old boy. I'm like I'd rather not say. But she insisted! So I told her that I think Teletubbies especially Tinky-Winky are gay lol. And she was cool about it she was laughing too. So the next day I get called into the managers office both store manager and assistant store manager told me she made a complaint on me. And asked if it's true what I said. I was like yeah Tinky-Winky is a Fag. They both looked at each other and smirking "well at least he's honest" ok don't do it again.

Whole Foods has responded by countersuing Brown for $100,000 and producing surveillance footage that seems to disprove his claims
Brown posted a video that showed the sticker on the side of the box claiming that he did not tamper with the cake
Video of him checking out the cake from the store shows him looking at the top of the cake and shows that the sticker had been moved

The company said in a statement; 'After a deeper investigation of Mr. Brown’s claim, we believe his accusations are fraudulent and we intend to take legal action against both Mr. Brown and his attorney.'
