If it is legal during day it should be legal at night and vice versa. It is repeat of the stupid night time speed limit changes we used to have. The law is basically saying it is ok to stop crime at night, but ok to commit it during the day because don't worry it is illegal to shoot you then. Fucking stupid but the the cop should not have chased them. But a bad guy is dead so good on that note.

              Time change has nothing to do however with the emotional, as opposed to what should have been rational, actions by an off-duty officer.

                      To say it's OK to stop crime at night by using deadly force is not what the law says. It only allows for a defense to prosecution after doing so. It is still likely that someone who uses deadly force against another, particularly for a property crime, will have to justify their actions to the satisfaction of a grand jury.

Why differentiate between night and day at all in written law? Just say it is a defense to prosecution if you are defending your property.                               The reason for it being written that way, as explained to me in a long-ago CHL class, was that it would presumably be more difficult for a property owner to determine if the perp committing the property crime was in possession of or brandishing a weapon after dark.

                                The cop obviously overstepped his authority and the bounds of the law...and should be held accountable, but the two douche bag punks that instigated the situation by their own actions
                                hold some responsibility/consequences for the outcome as well.

                                It's a terrible situation for all parties.
