The law clearly states you are authorized to use deadly force. A defense to the prosecution would be a 19 year old banging a 16 year old.
Guy in OC shot some kids a while back for stealing his hubcaps at night. It was still wrote up as homicide but the grand jury failed to indict him because the law clearly states he was justified. Just because you can doesn't mean you should. It will still be a pain in the ass.
DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:
(1) if he would be justified in using force against the other under Section 9.41; and
(2) when and to the degree he reasonably believes the deadly force is immediately necessary:
(A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or recovered by any other means; or

The local Fox channel indicated that the changeover to daylight saving time was what had made the offense pre-nighttime, which they said was 30 minutes past sunset. Had this occurred on standard time, it might have indeed been more defendable by the officer.

Farmers Branch officer arrested for murder, assault in teen's shooting
DALLAS -- Addison police have arrested Farmers Branch Police Officer Ken Johnson for murder and aggravated assault after he chased down two burglary suspects in his personal vehicle and opened fire on the teens, according to Chris Livingston, an attorney representing the officer.
Johnson shot and killed 16-year-old Jose Cruz in the incident. His family has called for justice since the shooting, saying the officer did not have to shoot the teens.
The officer claims he saw Cruz and Edgar Rodriguez breaking into his personal vehicle at an Addison apartment complex. The suspects took off in a red Dodge Charger and he gave chase in his personal vehicle. Surveillance video taken during the chase appears to show Johnson bump the suspects' vehicle with his own, causing the suspects to spin out.
Moments after the vehicle was stopped at the intersection of Marsh Lane and Spring Valley, a witness took a video that also appears to show Johnson pointing a weapon at the vehicle. Police have not said if any weapons were found in the suspects' vehicle.
Farmers Branch Police Chief Sid Fuller said Johnson violated department policies in chasing the teens in his personal vehicle while he was off duty for what would have likely been a misdemeanor offense.
Fuller's department is handling the internal investigation in the case, while Addison police are in charge of the criminal investigation. Fuller said he was waiting for the criminal investigation to conclude before moving forward on any personnel matters.
