You apply as an asylee if you are already in the country or at a port of entry, and you apply as a refugee if you are outside the country.
Either way, you have to be "under persecution"They can no longer live in their home country due to a reasonable fear or proof they will be persecuted.
The reason for their persecution is related to their race, religion, nationality, membership in a social group, or political opinion.
For the purposes of this discussion asylees and refugees are the same.
