  • Anyone know anything about car insurance Diminished Value Claim?

    Back in July my fiance was struck from the rear by a Chrysler van carrying the suckiest insurance of all, Fred Loya. The vehicle had over 5k of repairs done to it. It didnt mess up the frame but it doesnt drive the same anymore. We just purchased the a 2014 Jeep Patriot 4x4 brand new last year so now as of today we have 14,100 miles on it.

    Well we now want to trade it in for another new vehicle but the dealership, I know, wont give us what the vehicle was worth before repairs were made now that it has a carfax on it. So I heard from another party that deals with the trade in values at Sewell about claiming a Diminished Value Claim. Its where an insurance company gives you the difference of what it was before being struck to what the dealer is willing to offer you at trade in value. Has anyone gone through this?

        You have to have proof of the diminished value so you'll have to get an appraisal of the vehicle. And good luck trying to get Fredy Loya to pay you diminished value even with it.

            count your lucky stars that F.L. actually paid a claim. Last I heard they had the highest unpaid claim rate in the country, and they arent nationwide.

              One of my shops stopped taking FL jobs without a check from them first. They would do a tear down and estimate and wait to get paid before doing anything else at all. Sounded like they got burned a few times before they started that.

                There is a statue of limitations which I believe is two years. There is usually a process for a diminished value claim, you will have to hire a personal adjuster and present that to FL. You may also file under your own uninsured/underinsured for diminished value if there was a cap of what they paid out based on the type of claim and the persons property damage limits of course.
