Unfortunately for him, the law says any device that "by its design causes alarm or reaction of any type by an official of a public safety agency" is considered a hoax bomb.

So we know that he didn't engineer anything. All he did was put clock parts in a case - which is to say, he designed it - specifically to look like a small fake bomb. There's definitely enough evidence here to charge him with a Class A Mister Meaner.
