  • Question about (alcohol) open container

    I know beer is a no no but what about a liquor bottle? I'm going camping this weekend and had a bottle laying around that I was thinking about stashing in my cooler but wanted to know if that's legal or not.

    You can have an open container of liquor in the car as long as it is not within reach. So if the cooler is in the trunk or in the bed of your truck then you are fine.

        What about wrapping some duck tape around the bottle neck and top? Will keep the liquor from spilling too.

            Based on my defensive driving instructor, Its legal if its in the trunk or behind the last row of passenger seats for sure.

            I believe its also just a ticket...so as long as youre not drunk theres no major risk.

              I've been stopped and ticketed for other things when I've had opened bottles of liquor in the car. Just keep it out of reach.

                "Sec. 49.031. POSSESSION OF ALCOHOLIC BEVERAGE IN MOTOR VEHICLE. (a) In this section:
                (1) "Open container" means a bottle, can, or other receptacle that contains any amount of alcoholic beverage and that is open, that has been opened, that has a broken seal, or the contents of which are partially removed.
                (2) "Passenger area of a motor vehicle" means the area of a motor vehicle designed for the seating of the operator and passengers of the vehicle. The term does not include:
                (A) a glove compartment or similar storage container that is locked;
                (B) the trunk of a vehicle; or
                (C) the area behind the last upright seat of the vehicle, if the vehicle does not have a trunk."

                    "Open container" can also mean a 6 pack of beer with only 4 bottles depending on the officer's interpretation/attitude.

                      This is a timely thread. I figured I'd ask the board for recommendations on not only a good DWI lawyer, I want the name(s) of some of the absolute best available. I don't need a lawyer now nor (hopefully) do I plan to ever be in that position, but recently my employer has been cracking down on certain levels of misdemeanors on people's criminal history which includes DWIs to the point 2 guys were recently fired for something they found that dates back a couple years.

                          That has nothing to do with the DWI itself, you'd need a corporate lawyer, but don't waste your time/money. A member recently got fired for something as innocuous as foul language, against policy is against policy.

                            He's talking about knowing a good DWI attorney so that he's never convicted of one in the first place.
