And in your contract, you stipulate that you won't use the vehicle or property for illegal acts or they can demand the note due or reposses to satisfy their interest. Because if they give it back and the guy gets popped dealing again, they no longer have an "innocent owner" defense.Originally posted by racrguyWhat's your beef with NPR, because their listeners are typically more informed than others?Originally posted by racrguyVoting is a constitutional right, overthrowing the government isn't.

Originally posted by Broncojohnny View PostDon't claim that anyone in the police department cares about innocent owners. That is a fucking lie. The innocent owner defense only works if you have a lawyer backing you up to enforce it. In fact, if you bring it up the police and the DA will start threatening you with other charges or start claiming that you are going to have to pay their legal fees if the case is decided in their favor. The ACLU has a stack of cases where that scenario has unfolded many times. As I said, most banks have lawyers sitting around with nothing to do. They eat shitheel cops and greenhorn public counsellors for breakfast and that is why they get their property back.
I'm just trying to enlighten you guys to the process. I never said I agreed with ALL of it, some yes. But I do have some education on the matters at which are being discussed. As for the matters I bring you facts and cite my sources. Just like the original discussion on the trailer, it was confirmed stolen. The guy that had it bought it from someone who probably bought it from a THIEF. Don't by shit without titles people. In that case I cited the texas supreme court ruling on seizing suspected stolen property. And low and behold the trailer in question that started this was stolen...
As for my opinions on dope dealers. I could care less if you agree. Support them all you want. You show me a thief , and I bet their a doper...Got no use for any of them.
So, cusss at me when you have no legitimate response, thats fine. I just try to offer real answers when you guys bring up these topics , rather than the pissing and moaning responses that have no foundation...

They do their best to only steal from folks who don't have the deep pockets to fund a legal battle.

Illegal drugs, a whole different ball game. Drug dealers are scum and pray on the weak to make their profits and support their habits. They care nothing about what happens to the users. Eff them.
As for all this seizing property happy horseshit, here's my solution. Constitutional amendment saying no government seizure of any kind in all the land, can ever used to add to the gub'mint coffers. It all MUST be given to charity, within 30 days, no exceptions. This includes all levels of government from top to bottom. The government has the only source of income that it needs, which are taxes. Trying to circumvent this law or ignoring it results in immediate removal from office followed by public hanging.
Without the ability to use it for their own gain, you'd see that they can't be bothered to confiscate anything that wasn't involved in actual crimes.WH

At that point, anyone with an interest can assert their response. In the case of a lien holder , it would be an innocent owner defense. The DA's office civil section handles these. The DA will generally reject cases with an obvious innocent owner, or a lien that outweighs the value of the vehicle.

Years ago it was figured out a bunch of gentlemen had a fake company set up that was holding a fake lien on big money cars that were paid off by people doing bad things. I think the IRS stepped in and seized the business and every car attached to it, then divided it up. Like 10 or more cars and some high end exotics. There was a article in the paper on it as all the cars were held at a local PD.Whos your Daddy?
