  • Real estate attorney in Dfw?

    Anyone have a recommendation for a real estate attorney in Dfw? Selling our house in Frisco, and we are looking to terminate our current agent. He is being very difficult about the situation, basically presenting us with a termination clause that pays him his full commission for early termination. He owns his real estate brokerage, so there is no management to speak to above him. At this point, we need a good attorney to consult with to see what our rights are to terminate the contract we have with him. Any leads would be appreciated!

    What did the contract that you signed say about termination?

      The conditions of termination weren't in the original contract...this was sent after the fact in a tar1410 form that wasn't agreed apon when we signed the contract. From speaking to several people, most agents will terminate the listing for a small amount to cover some of their time and expenses. Contract ends Aug 31...just trying to see what our options are to terminate the listing before then.

        Wait it out. For what you will spend on attorney fees and paying the agents "fee", you might as well just wait it out. Maybe that will spur the agent to get people interested before the deadline. If the contract was 6-9 months longer, then you might be better off getting out of it.

            I'm not sure what all he does with real estate, but this guy handled our case in suing/collapsing our HOA...extremely helpful and won our case with no issues.

              Sounds like he needs some yelp reviews to help people know what hes done wrong.

                Basically we had a contract on the house that fell through on the last day. So there is a dispute with the ernest money that is tied up right now. Just haven't be satisfyed with his level of communication or his ability to market the house again. There was no hard feelings really, just wanted to go with different agent that has more experience with houses in this area. That's when he started not replying to txt/emails and setting outrageous terms to go with someone else. Most agents we talked to said it's pretty common to go with a different agent when you arent satisfyed...but this guy really wanted this house on his portfolio..so he has feelings are really hurt.

                  Seems to me that he'd have been better off by asking how to become a better agent to keep your business, instead of throwing an unprofessional tantrum.

                  I can see why you'd want to switch now, and not give him the extra month to sell it out of pure spite, but it'll cost you. I agree that waiting it out is the more level-headed approach, unless it's worth it to you to make sure he doesn't get credit for selling the house.

                    Thats pretty much any real estate agent ive ever worked with FYI...they all suck. Especially in north texas when houses sell themselves pumping up their egos.

                      Wait it out, the legal fees will eat up any savings. Who is the title company?
