He's putting the money in the HSA, right? So he's paying for the beer, just not paying income tax on the money used to buy the beer. Basically, he's cheating on his taxes, and if he were to get audited he would get dinged.

Not sure on HSAs, but Walgreens might be the one to take the hit on this in the event of an IRS audit. I know that FSA administrators generally toe the IRS allowable expense line before disbursing money back the individual who contributed to the account.

Based on the op, this is the type where you get a debit card with funds pre-loaded. What you are describing is the type that reimburse you. The responsibility is on the guy cheating on his taxes, not the store. At least imo.

That's one you may want to look into. Generally anything remotely medical in nature is OK (like Bandaids, cough drops, etc).
