  • Frost, what should they have done ? Should they have driven the 50 miles to Denver to look for him in that city ?
It's a terrible case, but you gotta be reasonable. You can't expect Royce City PD to drive to Dallas to look for some guy that took his OWN kids. Yes things are a little different these days, but dude seriously that was about making money off those kids death.

        Section 2.

The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the United States, and treaties made, or which shall be made, under their authority;--to all cases affecting ambassadors, other public ministers and consuls;--to all cases of admiralty and maritime jurisdiction;--to controversies to which the United States shall be a party;--to controversies between two or more states;--between a state and citizens of another state;--between citizens of different states;--between citizens of the same state claiming lands under grants of different states, and between a state, or the citizens thereof, and foreign states, citizens or subjects.

In all cases affecting ambassadors, other public ministers and consuls, and those in which a state shall be party, the Supreme Court shall have original jurisdiction. In all the other cases before mentioned, the Supreme Court shall have appellate jurisdiction, both as to law and fact, with such exceptions, and under such regulations as the Congress shall make.

The trial of all crimes, except in cases of impeachment, shall be by jury; and such trial shall be held in the state where the said crimes shall have been committed; but when not committed within any state, the trial shall be at such place or places as the Congress may by law have directed.

There's the list of the powers of the judiciary and what they may hear. I see no interpretation mentioned.

As to what the cops could have done in those cases? Take responsibility and say "Yeah, we had the obligation but there was nothing we could do. We put out an warrant for him for grabbing the kids and did what we could." Not "Fuck you, we don't have to protect you, we just get to write tickets and ride in vehicles you pay for."

Patrol cops in a small department don't write warrants. At the time of this incident they had maybe 4 detectives.(which work day shift) She herself said she allowed him to have the kids when it wasn't his visitation times. There was no indication that there was a problem other than he took the kids to an amusement park.
You're just looking for an axe to grind...Common sense and axe grinding don't jive.

Actually, my issue is that the police actually went to the Supreme Court not arguing they couldn't have done anything in this case, but rather arguing they didn't have an obligation to enforce the order or protect her or her kids. It wasn't that she was an idiot (which she was) it was police actually said "Fuck you, we don't have to protect you however, let's talk about you not wearing that seatbelt."

It will get interesting next weekend...

David Koresh will be holding a rally at Twin Peaks on Saturday.
