Child custody question

Just wondering if anyone here has gone through a similar issue during a custody battle.

To make a long story short, my ex recently got her kids taken up by cps. I only have 1 child with her, my 14 year old daughter who is currently in a foster home meanwhile I'm in the process to getting full custody.

I went to court today and it was reset for 10 days because cps needs to do a home visit to make sure my home is fit for her to move in. I am pretty confident they will give me custody due to my daughters mothers history, they were about to give me custody today at court except a delay because of the home visit. Currently I pay child support, does anyone know if the same judge can order to stop child support I'm required to pay monthly? Also, I would want her mother to pay child support, instead of having to go through a whole new process. I tried calling the attorney general but they aren't much help, they just said they just direct payment when ordered by a judge. I'm not one to really post that much private info like this on a public page at that, but I do know with so many folks here someone may have gone through something similar.

I don't have an attorney, the system is so screwed up. My daughter was taken from her mom 14 days ago, the only reason I found out was because somehow my daughter was able to get access to facebook this past Thursday and finally I was about to locate the case worker. It appears when they took my daughter and her brothers, my daughters mom told cps she had no clue how to get in contact with me or where I was. For whatever reason cps didn't bother contacting the attorney general to get my info since they have it all, they just took my daughter to the foster home along with her brothers. Dont get me wrong, I feel bad for the kiddos but they aren't my responsibility. Can you believe they actually asked if I would take custody of her other two kids, I was shocked that was even brought up. My main concern really is the child support now, my daughters mom hit me with about 15k of back child support even though we were together for the first few years she claimed I never helped her. It took forever to have that off my credit as it pretty much made me years late until I just bote the bullet and got it all cleared off. You guys would laugh, but I put myself on child support from the get go back in 04 when her mother stopped letting me see my daughter, thats when she got greedy and screwed me with the back pay. It would suck if I still have to pay her after I already have custody, which I'm pretty sure s going to happen. I waived an attorney today for the next hearing in
10 days because I felt pretty confident I will get custody, then when I started to think everything through I realized I am no attorney and now I'm stuck trying to figure out evrything...

Thanks. I can't wait, I just she doesn't react different from what I'm hoping. I had talked to her a few months back regarding her moving in but she changed her mind.

Now go to bed, get some rest, clear off a couple of hours of your day, and call a family law attorney tomorrow. It'll be worth it to square all this shit away sooner rather than later.

Join Fathers for Equal Rights immediately, and go to every session you can between now and the hearing date.

Child Support won't automatically stop. You'll probably need to file a temporary custody order, and I'd recommend a temporary restraining order based on the reason CPS took your daughter. Although FFER may tell you the temporary orders aren't needed if you have a hearing already set. But they can help you get your paperwork ready at a fraction of the cost of a lawyer. You're going to have to petition the judge for everything. A notice to stop withholding, and you're going to have to petition the court to make the mother start paying.

Take some time and call these people today, and like I said go to every evening session you can between now and then. It will be the best move you make during this process. Sorry to hear you're going through this. I'd be pretty furious if I were you, knowing she's in someone else's care.

So true, I wouldn't be able to do their job for long. All it takes is for a kid to head to the school nurse with some bruises and the entire family other than the abuser will be in a halfway house by the end of the day.

I am in the middle of a custody battle that started in June! It is a pain in the ass to get custody! However I have done just that. First of all log everything! My judge caught my x lying so much he flipped custody before final trial and abated child support. So to answer your question the judge can order child support abated. Back child support can also be abated. Have your lawyer explain the circumstances. You will more than likely be able to have child support put on hold until your final trial. You will also need to file a TRO temporary restraining order, or your attorney will. This will give you custody without any visitation for the mother until your case goes to trial and the judge determines what a good visitation schedule is. I'd ask for supervised visitation. How did you not know the state of your daughter for 14 days? Never visit or talk to her?

This is pretty normal, the boys are in fact your daughters brothers. People do this all the time, depending of their life's priorities.
