long insurance question

  • long insurance question

    so my cousin wrecked his truck into someone friday...... it get sketchy with the fact my cousin "traded" vehicles with his buddy. so my cousin maintains insurance on the hummer in my cousins name he traded and the buddy keeps the ins. on the now wrecked silverado in the buddy name. well the insurance on the hummer is better (lower deductable, rental coverage) so does the insurance follow the car or the driver? sorry if this doesnt make sense, i barely understand myself just trying to help out my cousin.

    it follows the car, then the driver if needed for excess

        The policy on the car covers things and then the drivers policy takes over once the cars policy hits its limits.

          Mine covers me in a vehicle I acquire within 30 days if I don't put it under my policy immediately.

                      Sec. 1952.059. REQUIRED PROVISION: COVERAGE FOR CERTAIN VEHICLES ACQUIRED DURING POLICY TERM.

                      ...

                      (f) Coverage under this section for a vehicle that is acquired during the policy term in addition to the covered vehicles shown in the declarations for the policy and of which the insurer is notified as prescribed by Subsection (d) must be the broadest coverage provided under the policy for any covered vehicle shown in the declarations.


                      Keep in mind, you mentioned they "traded". If you cousin does not show proof of insurable interest on said vehicle, it may have to be filed under his liability coverage for his Hummer. This will raise the question of which insurance carrier he has his policy with, if he has a non standard carrier that gives customers an option to purchase a limited policy for a slightly lower rate...guess who could be out of luck. Therefore, his friends insurance may have to cover the claim, again it may depend on which company he even has since it could possibly be a limited policy itself and just as well not cover any drivers not listed on the declaration page regardless of permissible use. This can get pretty complicated, specially without details of when they actually trader, and how long ago your cousin acquired his "newly acquired" vehicle. If he didn't switch the vehicle under his insurance policy with the intentions of keeping the "better" coverage under his name, he may get a surprise.
