  • When you take someone to small claims do you file in your city?

    Ex returned my car with some damage that she claims is not her responsibility so I want to take her to court, she lives in another county though can I file in tarrant or do I have to file in county where she resides?


    Also has anyone done this before? How long did it take? Did you get payment?

        You are going to waste your time and money. You can't get blood from a turnip. Even if you manage to find the right jurisdiction for your case to be heard by a judge and a verdict is ruled in your favor, collection is a whole 'nother bag. You can get a judgement against someone, but that doesn't even remotely equal lining your pockets. You essentially have to sell the judgement to a creditor (like selling a $100 bill to a pawn shop for $10, or less), and take privilege in knowing she'll be hounded for the next 5 years.

        Most of my experience in this is real estate related, but there are multiple Justices of the peace in Travis County (Austin) and you need to file at the right one, and even then, it could be a major headache for you. Experience.
