  • Insurance doesn't cover this?

    Happened to a friend. His car was parked in front of his house on the street. He wasn't in the car. An older neighbor had some kind of medical event, blacked out I guess and plowed into the back of the car. The car that was hit is worth no more than $1500 at best, but it was this kids sole transportation for school. He isn't expecting it to be repaired, but to at least pay him what it was worth so he can get another car.

    The driver's insurance is denying the claim. They claim that since this was an unforeseen medical event that caused the driver to lose control, it is not due to negligence and therefore they do not cover it.

    The driver is refusing to pay for the car as well. No body wants to do the right thing even though its such a measly amount. Everyone is telling him to claim it with his insurance and let them sort it out. Doesn't that go against him though?

    He should talk to his agent for advice. It's why you pay for insurance. IMO, the driver's insurance should and will pay.

      small claims court? Insurance companies do shady things to get out of paying because they know you will not sue and be tied up in court forever!


      my wife was driving through a parking lot,had the right of way, guy got in his car backed into the back side of her truck - as she was moving forward and already partially passed him, and insurance only paid for 60% of it because "she didn't do all necessary steps to avoid the accident" like honk her horn, attempt to slow down or swerve, and flash her lights at him.....uhh hello!

        If the kid is carrying his own insurance, notify his carrier for a claim. They will likely go after the driver's insurance company and get paid back.

        Last resort would be small claims court but be sure to do it quickly and not let a time period pass that might not allow to file the claim.

          Yup - kid's insurance should cover it and go after the other company with no strikes against the kid.

            That's a bunch of bullshit, when I was in highschool, an old dude had a heart attack while driving in front of our house, went over the curb, took down our fence and a fire hydrant. His insurance paid for the fence, the city's fees on putting the hydrant back up, and even gave us an extra check for the soil and grass that got washed away and torn up by the equipment.

                Unless he had collision coverage, he is screwed. This happens all the time and unfortunately it's on the owner of the vehicle.

                  I was hit by an older lady who blacked out behind the wheel about 8 years ago. It took some time but her insurance paid (farm bureau I think). Tbey paid for my truck which was totalled and paid for my rental tbe entire time they were getting it sorted out.

                    Was there a police report? If he has liability only then his ins. will not cover anything. However his ins. can go after the driver that hit him. A police report will go a long way as well.

                      Its not known if the driver had a diagnosed condition that contributed to the event. Could have been a total surprise.

                        It shouldn't matter. Their insured caused an accident. The reason doesn't matter.

                          that driver would have a scheduled weekly "medical event" in the form of me kicking his ass every tuesday at 2pm CST until someone bought me another shitbox.

                              Burn his house down with him and his family in it.


                              Personally, I don't recommend getting an attorney. It's only going to cost him money and time, and he won't ever see a dime from it even if he wins the case. Small claims court is absolutely worthless. Claim it on the kid's insurance, and let them go after the other insurance company. That's really the only solution that is going to get them anywhere.
