I have a buddy whose Dad passed away almost 5 years ago; there was no will involved, they didn’t have a ton of money and my buddy was a minor at the time his Dad passed.
Fast forward to today he received a call from a bank that tells him they are in possession of a safe deposit box in his Dad’s name but he can’t have it since there is no will or any legal documentation linking him to the box. The bank has held it for 5 years (required by law if it is delinquent) but now the 5 years is almost up.
He has the death certificate and some power of attorney form-they wouldn’t accept that.
Tried to file a small estate affidavit but they won’t accept it because the contents of the box are of an “undetermined amount”
Anyone dealt with this or knows of an attorney that can give some direction on the cheap?
