Sucks that you are having to go through all of this.. Did your wife get pics of the other car (and hopefully the driver)? That should help prove who was driving, and the car. That's one of the first things anyone should do, especially since most of our phones have decent cameras now. Pics of both cars, wider angle stuff of the area. Make sure to get the plates and try to get the other driver in one of the pics "accidentally".

If you file the claim with your insurance, and they determine the other is at fault, your insurance will subrogate and it should not hurt your premiums. Also, even if your wife is found partially at fault, as long as her "portion" of fault is 49% or less, it should not affect premiums. At least I know that was what has happened with me in the past. After subrogation I was found 30% at fault.

You probably wouldn't have to cover a deductible either.

**Please note - I am not an insurance expert, so first confirm all of this with your agent. They should be able to walk you through all of this, even if you decide not to file on your own insurance.
So as of now looks like the cop might of transposed a number on the vin and gave us the insurance company for another 2002 BMW that (probably 1 number off). I have a message in with the officer to see if he can help out. I do have pictures of the car and found a mugshot of him in the denton county records lol. I have the plate # but it was paper plates. hoping the paper plates will be enough to help us hunt down his insurance provider.

he didn't have proof of insurance on him so the officer just looked it up on his database. thats where I'm thinking he got the # wrong. Hopefully they will be able to help me find this kids info!

Id take that paper plate number to the tax office and have them run a report on it.

Temp tags do not provide any information on insurance. Also if they are Agent tags there is no car info on them either. Only legit temp tags have any vehicle and V.I.N. info, but like I said zero insurance information.

You sure about that? They took my insurance info at the tax office when I got a temp tag.

They took it to look it up most likely. I have yet to ever see any temp tag ran have any insurance information. So, at this point I am 100 percent sure!. However, that could be changing and it is a very slow process. They just started putting in colors of vehicle and a few other tweaks a few years ago.

Well, just because it isnt in your system, doesnt mean it doesnt exist. Also, just because they took my card and entered information off of it at the tax office doesn't necessarily mean that it's in their system, either.

what I'm hoping is the temp tags can get me the correct VIN and from there I can get insurance info....I got the temp tag number but that's it. Hoping the officer calls me back on monday and is willing to help. Going to be a long weekend!

His statement was that the officer looked it up in his database. When we tell people this we are going back to the cruiser to run the LP and it will pop up on the registration. They even have people that are not allowed to drive the vehicle, living in that household, on there now. I have never seen anyone at the tax office enter any information on insurance and I have swapped a few vehicles in my life. They set it in front of them while they are typing out the other info and then hand it back. Kind of like going to the inspection place. The tax office has zero to do with the insurance listed on our returns. I do not know how exactly that is maintained, but it is on the insurance agents end. The best we can do is call the insurance company listed on their card and verify proof of insurance. The vehicle returns are great though. They give company, agent, and policy numbers. Not at all 100 percent reliable though.

If temp tags, I assume that means recently purchased, so he may not have even added it to insurance yet at the time of the accident.. You have like 30 days, right? And as far as I know it's automatically retroactive to the date / time of purchase?

I'm sure someone will correct me.

If the guy has plated it now. If it is a temp tag still, it will most likely not show up. I would turn it over to my insurance and let them go after him. That's why they are paid the big bucks. I have done actual accident reports, and seen the at fault insurance not pay. Trust me, people call me and ask me. Usually fly by night insurance carriers though.

My insurance will cover me on anything I drive. Even if I bought a new car at midnight on a Saturday and didn't call them until Monday I would be covered. However, I have State Farm and been with them 30 something years. If that kid or car is not on their policy I doubt they would go back and retro anything, but you never know. I am not the insurance expert as far as all that goes. A lot of folks buy a 6 month policy and then cancel it after one month and keep the cards.

My problem now is even finding out if/who he uses for insurance since the info I got was wrong. If he doesn't have it or an issue like that comes up I'll definitely go my route but I figured it would be worth trying to find out who his is (if he has it) first and going through them. For all I know he has a name brand company (supposedly told my wife he's got rich parents) but I just don't know who it is until I can get the real VIN or find it from the LP. this whole thing sucks!

Ok so the plot thickens. insurance agency says their car is in Lake Jackson (S. of Houston) and wasn't in an accident. they say they have pictures of it and the VIN on it.

next question...is there a way to lookup insurance company information by VIN #? I have the vin for the car but want to verify the info all matches up. Basically I'm being told there are 2 2002 BMWs with the same VIN in Texas....

I know they say it doesn't count against me but I'm still not sure I believe it. I know for sure if I don't file with mine it won't count so trying that first. Just hoping to do a little research myself first before this thing gets any worse
                              You're wasting your time.

File a claim with your insurance. It won't count against you if the police report clearly shows the fault of other driver, especially if there was a citation. What will happen next is your insurance will subrogate and your deductible will get refunded at the end of the process. It is a pain in the ass, but this happens all the time. Allstate is the worst at denying claims in situations like this. Because what they do is try to contact the policy holder by phone/email. If the person does not respond, they will not pay the claim. It's very shady. Where as a company like Farmers will pay the claim, even if they can't get a hold of their policy holder during a specific time frame.

Thats what I'm afraid of. Last time I did this I didn't ever get my deductible back. there wasn't a citation but it does show in the drawing and on the report that they were at fault. I'll probably give it a few more days before I report it to mine but ultimately I will go that way if I have to.

I actually called the kid today and he answered but gave me a runaround and said he's calling his lawyer and will call me back....I'm sure he'll never answer my # again when he sees it
