  • Buying a car out of state from a power of attorney

There is a guy that is the power of attorney for his deceased dad's stuff and is wanting to sell his dad's car and I've never went thru any of this kinda stuff. I have purchased a car out of state and did the green sheet at inspection time. Should I stress over the whole power of attorney deal, what paperwork should I have at the time of transaction?

Call the dmv and see what they need.

If the guy is dead there shouldnt be much of a problem unless the guy is fucking his siblings out of money.

Power of attorney is only good while the person is alive. You need to get in touch with the executor of the estate.

Power of attorney works fine if TX doesn't know he's dead

get an affidavit of heirship. Make the responsible parties sign it. This has worked for me in the past.

I assume he has the title, it's just in his dad's name?

Just have him sign his dad signature if there a problem then go from there.
