        Hate to say it but a attorney won't help the car "total". If the estimate doesn't get up high enough to total it then there is nothing you can do but sell it after its fixed. You c an ask for diminished value claim but all that will do is possibly get you some money but won't help total the car.

          Need to be talking to the shop it's at and ask them to find everything they can and get the total over the 70 percent.

            How does that work? When I was T-boned the ins company said that depreciated value on a vehicle was a BS thing and they were in no way going to consider it or pay anything extra for it. But with carfax and things like that these days people are going to offer less than what an un-wrecked vehicle would go for. Do dealerships do the same things with a trade in?

              Exactly what I was going to say. Good shops write good estimates, and supplements. Cheap shops accept whatever the insurance gives them.

              I had an adjuster write a $4,000 estimate, once we were done it came out just a tab over $14,000

                I know the adjuster himself and he said he got everything in there that he could get in there. :-\

                I just don't understand how they wont take diminished value into account when determining the value of the car.

                  I'm saying there's no difference in paying a lawyer 3K or losing 3K on trade in after repairs.

                  I'd rather a lawyer not get my money though.

                          Lawyer or not unless the body shop totals it then it's still gonna be your car. Just trade it in once you get the car back.

                            The body shop does not total your vehicle , the insurance company does.Depending on the company they will repair up to 100% of the ACV . You may ask them to concider the average salvage return .If it is desirable model it could bring a 70% return.
