  • Looking for an auto accident attorney.

    Long story short...Got into an accident. Total damage done to the car is close to totaling the car out but unsure if the insurance company takes into account diminished value or not.

    Not wanting the car back with the damage done to the car so wanting someone on my side to help fight to get it totaled. (dont feel comfortable letting my wife and 8 month old daughter in that all the time)

    Why do you need an attorney to argue with your insurance company? If they give you an offer, counter until you're satisfied.

    Did anyone sustain physical harm? Was the accident your fault or another driver's? And are you prepared to pay attorneys fees to get the car totaled?

      Not at fault, going through my insurance due to under insured who caused the accident.

      I've never had to deal with totaling a car out, at least not one that was borderline, so want to make sure it is handled, etc.

        Have they given you an amount or settlement offer?

        I had a truck that was totaled, they tried to offer me a settlement that consisted of the amount I paid + recent repair work. I bought the truck from a customer that used it to offset an amount that he owed me. So instead of paying $15k, I paid $5k + $4k, so they offered me $9k, when replacement was between $15k-17.5k.

        They had the check cut and I told the guy to shove it up his ass. They essentially tried to piggy back my good deal. When I explained the business deal and that I had essentially $15k into the truck total (cash + repairs + discount offset) they adjusted the amount and covered me, which was essentially replacement value.

        Have a number in your head, stick with it. It's like any other negotiation.

                How close are repair estimate vs private party fair value on kbb? if its 1-2k they could be sweettalked into writing it off but if its 5k+ nope.

                    Retail Good condition on the car is $21,000. Current repair estimate is $14334 so $600 away from 70% not including rental and diminished value.

                        Just got off the phone with the insurance guy. He is saying he needs to see $17,600 in damage to even start the process. So another $3,300 in damage. Which, they wont find I dont think. But they also do not take into account diminished value of the car for the value of the car. So clean and clear the car is worth $22,000 (to them) but after the accident the car is more likely worth $18,000 - $19,000 which changes the %'s they need.

                        This is why i'm looking for advise.
