      Damn that's a tough break! Looks like you've been so close to cleaning it up after drawing the short straw several times. I'm hoping your lesson is a bit broader than that and you're just venting though.

      Have you checked anyour independent onshore companies? An independent will have different rules. If you're willing to travel, I can't imagine things will slow down in saudi...ever. they are pushing extremely hard to expand.

        Yeah I'm venting. And yeah that whole incident was a lesson I'll never forget. If this gig falls through I'll just stay put for a bit. I've been through the ups and downs like this 5 times in the last 9 months and it's exhausting.

                  The company couldn't hire me with a felony on my record in the last 7 years. The HR woman went to bat with her management using a court document I have showing it a misdemeanor, but in the end they had to stick to the letter of the law... which is - if the background company returns with a felony charge, no third party document is going to over ride it.

                  So I got the final word that they could not move forward on this past Monday Nov. 17th.

                  I did a lot of research and discovered that I could dispute the background results directly with the company, and that company would return those results directly to the employer that requested the original check.

                  So I obtained a very official document with the Arizona State seal and the signature of the judge in Maricopa County, along with the phone number of the County Clerk, and submitted that info using the dispute process on line. I also had a conversation with a guy in their compliance dept prior to sending it. I sent it at 6 PM Thursday evening.

                  At 1:50 PM yesterday I got a result back that had the charge changed to MISDEMEANOR, and that was sent directly to the employer.

                  The position is still open, and there is going to be another meeting about it Monday morning. So, we'll see. Hopefully this thing has not been such a pain in the ass for them that they'd just as soon wash their hands of me and move on...

                    Hoping the best for you. I would think that your perdistence in correcting the matter shows more about your character than the misdemeanor, as well as a strong desire to be a part of their company.

                      Thanks man..... the whole thing really irritates me. I take full responsibility for my actions, but Arizona was the worst state for this to happen in. They have 6 degrees of felonies, whereas Texas only has 3 - or 4 if you count State Jail Felony. At any rate this would have been a misdemeanor in Texas.

                      And yes, hopefully tenacity counts for something. The headhunter who recommended me for this job has been in my court the whole time and couldn't believe that I was this determined. Also the HR woman has been supportive and seems to be in my court all along.

                      Her management stated that "We have to go with what the background check company returns as the ultimate gospel and truth. They are trusted and very accurate."

                      Well now they've returned the result of misdemeanor, and I am still the same good guy that they thought enough of to offer me nearly a 6 figure job, but this time I meet all of the background criteria as well. Like I said, we'll see.

                      The salary and benefits would be the best I've ever had and would propel my career to an entirely new level, and I wasn't willing to give up easily when I knew I had been shafted by the background check.

                            Exactly... the same effort I put into clearing my name and "never give up" approach demonstrates my tireless work ethic and willingness to see things through to completion no matter what hurdles must me overcome.... and so forth..

                              Consider talking to a lawyer concerning your legal record, to get things straightened out and to also to properly arrange your record.

                              You seem to have a lot of added items to the initial legal issue. Get the final disposition into the record properly.
                              Background checks will usually stop at the word felony, and not read through to the end.

                              This is because most companies just don't need to accept a potential employee with even the slightest taint let alone a record that has the red stamp of felony at the top, and anyone who handles the requisition is also taking on a similar risk for "going to bat" for the candidate, people just don't need that(no matter what they tell you). That seems to be what is happening, the background check stops at the first paragraph of your record.

                              Sounds like there *could* be a lot of value in working with a lawyer to reduce the impact of your record for job prospects.

                                Yep. I am working on it. It is hard to do all of this from Texas. I have learned quite a bit about all of this. There are really 2 main sources background checks are extracted from.... the Dept. of Public Safety in most states serves as the central repository for quite a few of the records, and the rest come from the courts. The records from the courts are harder to fix at the root. Phoenix is the worst, according to a Phoenix attorney. I talked to a good one, and he wouldn't even take my money. He told me any of the "expungement" attorneys will only work to get a Judgement Set Aside order, which is yet another line item that may or may not be seen during a background check.

                                DPS records can be appealed and possibly amended through a dispute process much like the one I just finished doing with the background check company.

                                Another option if this ever comes up again is to sign the consent for the background check and include my evidence of how the case was ultimately disposed of.

                                It's all a big lesson learned and a pain in the ass. If I can land this job it will be great satisfaction, and a miracle for sure. This has been going on for a month and a half now. And it's been agonizing.
