        I'm sure there could be a debate about it due to initial PC to even investigate the other party's BAC, but if suspicion arises when you're called to the scene of an MVI, why wouldn't anyone be fair game? Especially someone admittedly driving on a public highway.

              This is purely anecdotal, but I have heard of situations where someone was driving drunk and another car hit them (other driver's fault) but since the drunk person should not have been on the road at all, not only did they get a dwi, but are also determined to be at fault for the accident.

              Again, purely anecdotal..

                15 years ago I rear ended a mini van...Normally when you rear end someone it is automatically your fault....BUT the person I hit didn't have insurance so it immediately became her fault because she shouldn't have even been on the road

                  What? The OP was not drunk prior to the accident. Obviously something was injected or similar that caused his BAC to be high. This had to happen while he was unconscious or otherwise severely traumatized from the accident - on his way to the hospital.

                  ...or did they draw blood at the accident?

                  ...and clearly he is still traumatized by incriminating himself on a public forum.

                    If it hasn't already been recommended, look up David Burrows in Dallas. He's actually received awards for being one of the best DWI attorneys out there...when my wife was doing her internship she said that the public defenders would go and watch him try cases.

                        Refusal gets you an automatic 180 day suspension of your license. Then they just get a warrant and take the blood...

                            http://criminalandfamilylawtx.com/ met this guy personally at a party. Rumor has it he has a ton of Collin county DWI dismissals and Collin county judges know him very well.

                              So I'm curious, how exactly do these lawyers get people off DWI's? I talked to a cop a while back and she was saying that a DWI arrest has to go down perfectly by the numbers or the lawyers will nitpick every bit of the procedure, apparently DWI's are a real pain in the ass. Any first hand experience here, would like to hear it.
