Sec. 49.04. DRIVING WHILE INTOXICATED. (a) A person commits an offense if the person is intoxicated while operating a motor vehicle in a public place.

(c) If it is shown on the trial of an offense under this section that at the time of the offense the person operating the motor vehicle had an open container of alcohol in the person's immediate possession, the offense is a Class B misdemeanor, with a minimum term of confinement of six days.
(d) If it is shown on the trial of an offense under this section that an analysis of a specimen of the person's blood, breath, or urine showed an alcohol concentration level of 0.15 or more at the time the analysis was performed, the offense is a Class A misdemeanor.
Intoxicated means either you had an .08 BAC or you had lost the normal use of your mental or physical faculties due to the introduction of alcohol or other substance.

I couldn't find anything for a defense to the prosecution or anything like that so your results may vary. I was given the reasoning as you had to prove impairment was the reason for the accident. IE: Fail to control speed, right of way, failed to stop etc. What act did you commit if you were not at fault.
I will tell you this. Working in two different counties is very eye opening. You get use to doing things one way and then you go somewhere else and it is totally different. There are things that are bigger deals than others. Like we have discussed before in letter of the law and spirit of the law. Different counties, different priorities.Whos your Daddy?
