    lol man so many ways to go about this but I don't know which is going to be best in the long run. I thought about just picking the car up but being 4 hours away and not owning a trailer makes it costly for me to get it. I am going to look into what you said FastFox and maybe I will see something down the road. For now, I guess I should pick it up and sell it for what I can and never lend again.

    Anyone want to buy a 97 M3?

      If I file 1099 as forgiven debt then I assume I also couldn't file a judgement in county court. Is this correct? Do you know what it costs roughly to file the judgement? I am still trying to weigh my options. I don't want to be a complete A-hole but also feel like he needs to learn responsibility and not walk away free.

              This is probably the best advice. A signed document probably isn't going to be legally binding unless you are an attorney and know how to write it. Even then you aren't a bank or a car dealer so you don't have the same rights they would and you definitely don't have the same amount of signed paperwork.

              What I'd do is figure out a reasonable way of retrieving the car. Either by renting a truck and a trailer or borrowing them. Document the mileage, fuel costs, waiting time, etc... Then once you get the car back have a couple of dealerships give you a written bid for the car as is and get some estimates for repairs to the same condition it was before you sold it.

              Come up with a value when it was sold (your signed document is probably sufficient for an agreed upon value), what it's worth now and what it cost you personally to get your property back and send them a bill for it. If they refuse to pay then it'd be up to you to decide if it's worth going any further.

                    Go pick it up and sell it. It's highly likely that the wreck and starter are just stories to get him off the hook for paying you. Even if he's not lying, a starterless and wrecked M3 is worth more than nothing, which is what you have now.

                        lol get me an address!

                        im going to pick it up sunday in abilene assuming it is still there. find out what needs to be done with it then sell it for what it is worth. he still owes about $4500

                          picked up the car this weekend. it looks like it was hit on the passenger side door area and the front bumper was cracked. The starter is out among many other little things here and there. I think instead of fixing it I will just sell it as a parts car. So, if anyone is interested I would like to get $2500 obo.
