Lol, well he knew what he was getting into, but the fact that he even on his off days he has to go pick the kid up almost 90% of the time because she is always "out of town" or "busy" and so he wants more custody. Thats what this is about, not a divorce sorry. They have been divorced for awhile.

If he hasn't already, he needs to start keeping track of all of the time he has the child. One of those "At a Glance" meeting planners dedicated solely to that would be best. This is something that can be presented to the court to show he is already getting the child far more often than his visitation dictates, and at a minimum he may be able to get his amount of possession increased based on that.

I would also make a special note on those where he was asked to take the child last minute.

An attorney would be a good idea.

Then he needs to start keeping track of every time he does this, quietly. Pictures with date and time stamps. Text messages from her asking him to pick the child up. Voicemails from the same. RECORD HIS CONVERSATIONS WITH HER. He does NOT have to tell her he is doing it, and it IS admissable in court. The flip side of that, is he has to be 100% peachy in his demeanor. No arguing, no cussing, nothing. Once he has enough of this, he can take her back to court for custody. It's going to take a while to build his case though.
