Friend got served by crazy ex-girlfriend with small claims, tips on responding.

Buddy of mine who lived in Minnesota (he has lived in Dallas the past 2 or 3 years but she still lives in Minnesota) got served by his crazy ex who is claiming he owes her like 7 or 8 grand. A constable showed up at his work to serve him the papers which is just a small claims petition filed in Dallas County. She claims he owes her a bunch for rent while they lived together in Minnesota, groceries, and that she paid off a loan for him. He said she's crazy and that none of it is true and wants to know how to respond to the petition.

Anyone been through this? I told him to contact a lawyer but I don't think he wants to shell out the cash at this point unless it actually goes to trial.

Most importantly, he needs to respond as instructed otherwise she will win a default judgement.

Being small claims, he doesn't necessarily need an attorney to represent him, but it may be a good idea to consult with one to help him out.

EDIT: BTW, this is the kind of case that they want on Peoples Court / Judge Judy and whatnot. You should tell him to try and get the case on there!!!

He should file a response to the court asking for itemization and setting a court date. She is crazy if she is from Minnesota and plans to come down just to sue in small claims. She has to be able to prove any/all those things or the judge will throw it out.

A lot of people file that shit hoping the other party will ignore it so they can get default judgement. Not that her getting a judgement will necessarily do her much good.

Judgements can be filed/applied against cars and houses in texas little harder than a bank account but it can be done.
