      Kinda the point I was trying to make. The writer went out of their way to make it sound like this guy was living high on the hog, but if you look at the picture in the article the garage he is standing in front of is run down. I also don’t think he chased her into the ally and shot.

        Watch the video. It seems as if her and the guy both escaped out the back door. The woman caught a bullet in the alley way behind his home. As much as I hate thieves this old man is probably going to get charged.

            Yeah I watched the vid just now. He's a defense attorneys' nightmare. In his situation, mum's the word. But he's all "yeah I smoked that bitch, and I don't curr!". Good luck to him.

                Yea that was one pretty pathetically written article. It is very hard to decipher whether or not the guy is 100% in the clear for his actions. The way this is written, it sounds like he shot her, then she begged for her life and he shot her again. I could see how she could also be saying that just before he shot her twice.

                        I'm no lawyer, but if it occurred as written, I think you're wrong. Once she was running away, his pursuit of her into a public alley with a weapon in hand, isn't really defending one's self. The castle doctrine affords you the right to defend yourself and your property, not chase people away and execute them. I believe if she had some of his possessions on her person and he feared them unrecoverable, he may have half a leg to stand on.

                          I believe since it was at night it might go better for him.

                          In Texas, if it's night and someone is stealing your lawn ornament, you can put them down.

                                It is a defense to prosecution if I remember right. Has to be at night and you have to believe that you would not be able to recover the property without the use of deadly force.

                                Shoot someone for running away with your yard Gnome and you might not have a lot a leg to stand on. Shoot someone for driving off in your truck and you have a better chance of beating the charge if the DA charges you.

                                Wasn't there a report a few years ago of a guy mag dumping his AK into his own car to "stop" the thieves from getting away with the very car he just riddled with holes?
