          Didn't Joe Horn (Houston) shoot a guy who was running away as well? He was cleared IIRC.

            The article reads as an execution not a stand your ground or castle doctrine case. What makes it an execution(as the article reads) to me is she was shot, fell down, and he admittedly shot her after she "begged" him to not kill her because she was pregnant. Where was the threat to the shooter at that point? Where was the risk of not recovering the item . His comments would lead me to believe he fired the second shot out of anger and not fear... Which to me would be admittedly executing her

                    I'm no lawyer, but if it occurred as written, I think you're wrong. Once she was running away, his pursuit of her into a public alley with a weapon in hand, isn't really defending one's self. The castle doctrine affords you the right to defend yourself and your property, not chase people away and execute them. I believe if she had some of his possessions on her person and he feared them unrecoverable, he may have half a leg to stand on.
                    Joe Horn shot at least one or both thieves in the back as they were running away. However, that's Texas where there is no duty to retreat. California may look at this very differently.

                            If you are pregnant don't break into houses and you won't get shot. If you do shoot someone don't admit to anything without speaking to an attorney. Tom Greer is not helping his case at all by talking to the media, it almost sounds like he's bragging about it.

                                He's figuring he's 80. He has only a few years to live left and if he goes to prison he'll get the best possible health care. It's no different than a nursing home.
