          I have a friend that is a prosecutor in North Texas. One of his major cities has no refusal 24/7 365. He says the AVERAGE BAC on blood draws is .18. I asked how many came in below .08. He told me he has seen a COUPLE, but drugs were a factor in those cases. He said that 99% of the blood cases PLEAD GUILTY. No trial.
          So, I'm on favor of the program. It's 2014 folks, how the hell do you not understand not to drink and drive.
          How do you not understand the right not to present evidence against yourself and that if you trade security for liberty you get neither?

            So based on your reasoning NO search warrant should ever be issued or executed because it might garner evidence used against you?

            This is a search warrant based on probable cause issued by a magistrate. It's not like the cops just pull you over and decide they're taking your blood. Tell me a person on this board that can't spot a drunk?

              I have a problem with drawing blood because it is forcing someone's body to provide evidence against them. The technology is up coming for scanning the brain to see how it response to stimulus. Perhaps we start hooking up suspects to see how their brain reacts to questions. They don't even need to answer the question to come to some possible conclusion.

                If it's that easy to spot a drunk, then why are you needing to collect a blood sample? All you would need is video evidence and officer testimony.

                    I didn't say that. YOu don't see the difference between a search warrant to search your house (legal) and one that has someone hold you down and forcefully draw blood from you?

                        The average person doesn't believe the average cop these days. Have you ever seen a jury pool ? Many are not exactly the "peers" you want judging you.
                        People WANT evidence to convict... not just someones word.
                        The line of questioning goes like this:
                        defense:Well Officer, you don't have a blood sample, why not?
                        Officeridn't get one
                        Defense:But you COULD have gotten a warrant
                        Officer:Yes
                        defense: But you chose not to ?
                        officer: yes

                        For the jury, it's an easy decision now...

                            It just makes their job easier Dave. You see, trampling all over everyone's rights is important because otherwise it might be too hard to win a case against people who don't appear overly intoxicated. We have to make sure we get those people who are at .09 BAC but are just fine to drive because not getting them violates the narrative.

                              Times change. People EXPECT more evidence and when you don't get it, they're suspicious.
                              And with a 99% Plead guilty rate on blood cases, why would you not go the extra mile and avoid a 2 day trial where the outcome is a crap shoot.
