So, either they changed the laws in the past few years, or they can make exceptions during certain times. Seems pretty fickle to me. I don't like the idea of being stopped and checked with no probable cause. I also don't like the idea that I could be .09 and driving completely safely and still get popped for it. And the idea of someone sticking me with a needle and drawing my blood without my consent in a situation like that sure doesn't sit well with me.
Agreed...and the "good" cops on here have no problem with this. If you have nothing to hide...

Just watch the news, those that enforce don't have to follow.

The whole no refusal thing is in place at all times in Texas. The state is saying that they can call an EMT to the scene to determine BAC. Usually they do it at the station and attorneys will argue rate of absorption and have a better chance of winning a non intoxication while driving case. Or get it down to obstruction.

Just saying its always in force.

Huge black cop walked to the front to make sure I had a front plate, looked at my good license, insurance, registration, and very well done fake inspection sticker, asked me if I built the car myself, then let me pass while all the other cops continued to watch, just itching to be the one to get to write me a ticket. I gave it some pretty good gas in first leaving, then toned it down so as not to break the speed limit. I had a huge grin on my face the rest of the day.

Holy sh!t, I didn't know you were this much of a badass!

            I don't see how that's possible.

Yes. Your body is the epitome of Private Property. If you can be compelled to bleed or give other DNA to convict yourself, against your will, that is a violation of the constitution.

Officers, if a citizen walked up and said "I think you've been drinking. I noticed you weaving while driving. Would you blow into this breathalyzer or let me stab you with this needle to check", would you be okay with that?

The investigation is a little more involved then just "hey you served" stick your arm our so I can draw your blood. Come on frost, you are so ridiculous.

Not really...just formalities. You tell a judge you believe the person to be impaired, he signs a warrant and you forcibly take his blood. I've seen it done.
