  • Need help with Homeowners Association

Anyone in here familiar with the rules and regulations that govern an HOA? I recently moved into a community where we have a real weak HOA that has 3 board members and an outdated set of CCRs, that basically tell us all the shit we cant do.

Im in need of an HOA attorney or consultant that can help us figure out what we can and cant do. Its a mess. It seems like our own rules are handcuffing us from doing anything. Im new to it all but it all sounds like bullshit.

For example.....According to the CCRs (rules of the community), you need 75% of community vote to make a change or amend something. Well half the people don't care and aren't involved. So we wont get 50% to vote much less 75. Does that mean nothing can ever be changed or do we have to basically force people to vote? That doesn't sound right but they keep coming back at me that its law. I don't know enough about it to even make an argument. Lookin for some help.

Damn 75% is pretty high. Sounds like you need to do some convincing..

Im fighting to just get majority vote for changes, 51%, or even a straight up vote for those who actually vote. But of course, changing that requires 75% vote. Its a vicious cycle and ridiculous.

They're not saying it requires the approval of 75% of all your neighbors to approve changes to your home.

It requires 75% of a quorum of voters to approve and that is reasonable.

No, not really, fuck most HOAs...

First rule to buying a house in a community with an HOA, is understand and agree to their by laws.

damn it...We're in the process of moving soon and HOA's are everywhere. I've seen very few areas that don't have an HOA.

Yes but, when you don't have anyone protecting your property with some rules, your place can be over run with Bill-Jacks building garden sheds out of shipping pallets .
