They will likely ask for a dismissal after you go for their throat and they see that they are not only going to miss out on a settlement, but that they'll likely owe YOU money by the time it is all said and done.

        City is largely irrelevant. You can seek a change of venue - personally, I'd get it away from a JP (I'm surprised it is listed as a jury trial, thought most JP's did bench trials, but I'm a novice), that may require a counter-suit with a value that exceeds the JP threshold, again, you'd have to research and see what those limits are.

        I had a civil matter go to a JP and that motherfucker didn't follow state law - jurisdiction was in MY county and he denied a venue change to accommodate me, then when I presented case law, he gave me the "opportunity to settle up before things got ugly." So my faith in JP's is non-existent.

            you will spend probably north of 10k for a decent lawyer to represent you. It cost me around 1600 for a couple of letters to be sent to a former employer.

              Yes sir, they really breached. No written notice was given, much less 15 days prior to closing as stated in the Third Party Financing Addendum. Closing day came and we were calling the title company to see if everything was a go, because we hadn't heard anything and our realtor hadn't heard anything.

              Yeah, I really need to talk to a lawyer to find out all the logistics, I don't know much if anything about this stuff. Seems I screwed up and read it wrong, it's set for trial, but no mention of jury trial. Received this and a jury duty notice the same day. So maybe no lawyer needed?
              I don't even know how to go about filing a counter suit. I'm open for suggestions. Hearing is in June.

              Sorry I read it wrong, I have this and a Jury Duty notice together on the fridge. So it does not say Jury Trial just Trial, sorry. (I'll edit op)

              Notice of hearing says case has been set for trial and is at Justice of the Peace. Precinct 3 District 1.
              So yeah no jury trial, it's just the Notice of Hearing. Sorry about that.
              So no lawyer needed?
              JP= Justice of Peace?
              My faith in the system period is pretty low.

                Always have an attorney, if for no other reason than to handle the procedural hurdles. My assumption is that they won't have an attorney (especially if they are fretting over $1000), so this is a prime opportunity to 1) fuck them in the ass, and 2) counter-sue with a victory under your belt.

                    this sounds like they are taking you to small claims court. just show up with your release and the information from the title company.
