I appreciate that he's done well with his life, but still needs to do his time. Prison is primarily about punishment, rehab is secondary, and I don't like the message it would send if he gets off scot-free.

I agree to an extent. His attorney tried to set the record straight and let them know that he wasn't in their prison system, they told him he was. The attorney advises his client that as soon as they find out he's not their they will come and get him. Sucks for him it took 13 years, but time to pay the piper...

I too am hard pressed to say make him serve time until 2026. He turned his life around without tax payer support and as mentioned his kids need him. I feel this way especially if there is a proof that his lawyer was truthful about his status. I tend to believe he was, because a lawyer is not going to assume liability like that for some client.

I think the main focus should be on the prison/government side of this and how it happened.

However, now the guy is screwed anyway. Any job he had is gone and any savings they had is probably going to get soaked up - if they had any savings.

Since he straightened his life out and became a good person, I think the judge should look at that and show him leniency and give him probation if he must. The legal system made the mistake and they shouldn't try to correct it by destroying his life now. Of course, being the vindictive sorts they are, they will probably try to add more charges to it.

            I see it 2 ways:

            1. He did commit a crime for which he was sentenced 13 years. He is supposed to serve his term like everyone else, get a chance at early release, etc, blah blah blah.

            2. Since the Justice \ Corrections system was so "certain" that this guy was already locked up and serving his time that they wouldn't entertain the lawyers responses that he was out on bail, I don't feel like he should be forced to serve his sentence now.

If it took the judicial system 13 years to figure out he wasn't in prison, that's not really his fault. He didn't escape or break out. I assume that there was a prison somewhere that he was on the roster of. You would think at some point they would be like "Prisoner # xxxxxxxx not accounted for" and begin the process of finding where in the hell he was at.

Based on Missouri's screw up I say let him go. The fact that he managed to become a normal working class guy with a family and personal business is just a bonus.

Does this mean the the tax payers paid their tax dollars for 13 years to the prison system to house an inmate that did not cost the state any money since he wasn't facilitated? I would be irate if I were a taxpayer there.

I would like to know if the prison system has been billing the state for his supposed incarceration for the last 13yrs.

I could be wrong but I think they still call those places "Correctional Facilities"

Seems to me he corrected himself........

Political correctness doesn't take away from the fact that prison is a punishment for fucking up.

Yes, it's called the statute of limitations, and has already been said, that applies to getting charged and tried for a crime. He's already been charged and convicted, so that doesn't apply here.

Sounds to me like they're embarrassed by it and taking it out on him. They fucked up, not his fault.

They should just ammend his sentence to probation. That way he gets punished but his family does not.
