            To me, that just reinforces the need to get them to the gallows faster. Trial may be more expensive for a death penalty case but there is a cost savings initiative to not spending decades at $90 a year on death row.

                        It's a part of the Constitution. It's been that way for over 200 years. The Founding Fathers seemed to think it was important enough to include in the Bill of Rights, for what that's worth. At the risk of sounding like forever_frost, you can't just pick and choose which pieces of the Constitution you follow (government excluded).

                        It doesn't seem like death is enough of a deterrent, does it? How much worse could torture be in the eyes of someone that doesn't intend to get caught or care enough about dying to not do evil things?

                            Eye for an eye IMO. Or hey bullets are a lot cheaper then keeping these fucks in prison. There are a lot of cases where without a doubt that person committed the crime, hell some fess up. Bang!!!

                                The Bill of Rights was ratified in 1791. I'm pretty damn sure there were plenty of public hangings that occurred after that into the 1900s. So, the modern interpretation of "cruel & unusual" differs vastly from what the founding fathers thought was cruel & unusual.
