Sometimes you have to put your foot in it on test drives. What dumbasses to go after hours for a joy ride though

I guess they have different laws than here in Texas, because that's straight up robbery here.

Where's Delaware? I'll never forget the call I got about my car being "ass raped" repeatedly on Inwood when I thought I was helping a tech friend make some side cash on wiring issues. Hope the guy gets compensation - but I also no longer understand owning a car that's irreplaceable.
I no longer shift gears - I switch beers. Cheers!

I didn't read the whole thing, but the guy bought his car new, right? The dealership wants to replace it with a previously owned one. How does he know what kind of care the car received? The car they are offering would show a previous owner before him on the title. He took his car to a dealership for service work and they totaled it. He's due a direct replacement okay -- exactly what he brought in - a car that was brand new when he got it so he knows 100% what kind of care the car has received. Since they obviously can't give him that, then they should do the next best thing -- a brand new one. Since they are trying to fuck him over and drag this thing out, then he should be compensated for it. Now, if it was a civic with 60K miles on it, then I agree he should take a car in similar condition.

Oh, and LOL at the suggestion that he should get like 5 years worth of free service/oil changes from the dealership. THEY TOTALED HIS CAR! Why in the world would he ever take it back to them. Besides, if he only put 10K miles on it in 2 years, he's not going to need much service work.

I was referring in addition to returning to him every dime he'd spent on it and paying his note off completely. They should buy that car for what he paid for it.

That I would be on board with as long as he truly could replace it with a equal car at a minimum. If the car had appreciated in value, then he should be due that money as well.

I didn't think about that part, his car was a one-owner car, but ANY used car tat they would give him would end up being a two-owner car, dropping value instantly.

They offered a "one owner" car that had 13k miles, had new tires(in his mind indicating it had been abused to need new tires in 13k miles), and some sort of appearance mods ("non stock badges front and rear"). It also ended up actually being a two owner car that had previously been in an accident.

Mind you, they weren't actually offering to give him this car to make the situation right. The dealership claimed that since the employee didn't have their permission to be driving the car, they weren't liable. So this "deal" was to let his insurance cut him a check for the totaled car, then allow him to purchase this "equivalent" car, minus $4k as a goodwill gesture to cover badge replacement and inconvenience.

I am with others in thinking that he may be out of line expecting a brand new replacement for his 2 year old car, but the fact that they are trying to force him to make a claim on his insurance company for their fuck up would be a tough pill to swallow Whether or not their employee had permission to take it on a joyride, they are still liable for their employees actions, and should step up and take care of this. The backlash from this among the automotive community will cost them far more than taking care of this the right way would have.

Its a figure of speech, sorta of speak. When a place gets broken into, people say the place was 'robbed'. That guy went (broke into, doesn't matter how.) into a place of business after hours and took (stole) a piece of property that wasn't his and totaled it out.
                        Stop being a moron cop

Same thing happened in Plano at a Acura/Honda dealership iirc, I believe it was a service writer, mechanic and secretary in a NSX, they came back after hours and took it for a spin and totaled it, one if not all were charged with a crime.

If I leave my car at a dealer for service and find out that an employee wrecked it when he never should have been in it, and it was less than 2 years old (same body style as the new cars, etc) I'd demand a brand new one. Period... The dealers make shit tons of money on new car sales, and they can eat the loss as far as I'm concerned. If it were just an accident then fine, I'm totally reasonable, but in this case nope! New car or lawyers, dealers choice.

well if he can afford a ZL1 Camaro then he can afford a excellent attorney and that dealer should be scared of that fact. wouldn't it ruin the reputation or would it be water under the bridge after the news of it fades away? interesting thought i guess!
